Terms of service.
Welcome to Refine Films. These Terms and Conditions set out the basis on which we provide video production services. By engaging Refine Films, you agree to the following terms.
1. Definitions
“Refine Films”, “we” or “us” refers to Refine Films, operated by Rob Wilson and Kieran Beauchamp.
“You” or “the Client” refers to the individual, company, or organisation engaging Refine Films for services.
2. Scope of Work
The scope of each project will be defined in a written proposal, estimate, or email agreement outlining deliverables, timelines, and fees. Any changes to the agreed scope, including additional deliverables or changes in direction, may result in additional costs and revised timelines.
3. Fees and Payment
A deposit of 50 percent of the agreed fee is required to confirm a booking. The remaining balance is payable within 14 days of final delivery unless otherwise agreed in writing.
All prices are exclusive of VAT unless stated otherwise.
Late payments may be subject to statutory interest and recovery costs in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
4. Cancellations and Postponements
If a confirmed project is cancelled more than 14 days before the scheduled shoot date, the deposit will be refunded in full. If cancelled between 7 and 14 days before the shoot, 50 percent of the deposit will be retained. If cancelled within 7 days of the shoot, the full deposit will be retained.
Postponements will be accommodated where reasonably possible. However, additional costs may apply, particularly where crew, locations, travel, or third party services have already been booked or committed.
5. Revisions
Unless otherwise stated in the agreed proposal, the project fee includes one round of revisions. Any additional revisions or changes beyond this may be charged at an agreed hourly or daily rate.
6. Copyright and Usage
All intellectual property rights in the produced content remain with Refine Films until full payment has been received.
Once full payment has been made, the Client is granted a non exclusive licence to use the final delivered content for the purposes agreed in writing. Any additional usage or distribution beyond the agreed scope may require further licensing.
Refine Films retains the right to display completed work for portfolio, website, social media, and promotional purposes unless otherwise agreed in writing.
7. Client Responsibilities
The Client is responsible for securing any necessary permissions, releases, licences, or location access required for filming unless explicitly agreed that Refine Films will arrange these on the Client’s behalf.
8. Liability
While every reasonable care is taken in delivering our services, Refine Films shall not be liable for any indirect, incidental, or consequential losses. Our total liability in connection with any project shall not exceed the total fees paid for the relevant services.
9. Confidentiality
Any confidential or sensitive information shared during the course of a project will be treated as confidential and will not be disclosed to third parties without written consent, except where required by law or where the information is already publicly available.
10. Force Majeure
Refine Films shall not be liable for delays or failure to perform resulting from events beyond our reasonable control, including but not limited to illness, accidents, extreme weather, travel disruption, or acts of God.
11. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
